Uralla Shire Councillor Natasha Ledger is listed to appear before Magistrate Michael Holmes in Armidale Local Court on Monday, December 10.
She faces one alleged count of Common Assault.
A guilty verdict against Ledger could trigger yet another by election for the Uralla Shire Council, this time under Section 275 of the Local Government Act.
The Act states a person cannot hold office if serving a sentence (including an intensive correction order) for a serious indictable offence or any other offence, except for failing to pay a fine.
Uralla mayor Michael Pearce said he was not aware of Cr Ledger's court appearance and had no knowledge of the matter, so was unable to make any comment at this stage.
