Christopher Dale Williams is being held in custody in the maximum security wing at the Cessnock Correctional Centre and was charged with two additional offences stemming from an alleged incident on August 19.
During brief proceedings in Armidale Local Court, Solicitor for the Director of Public Prosecutions (DPP) Ben Barrack said the aggravated break-in charges remain with the DPP but he needed to prepare a report to a Crown prosecutor to determine what charges would proceed.
"I understand the matter will be defended," he told court.
"I understand the new sequences will remain in the local court."
The 23-year-old faces multiple charges including two counts of aggravated break and enter and assault, and now faces an additional count of assault with act of indecency and steal property in a house, which he has pleaded not guilty to.
He has admitted to one charge of larceny.
Last month, Williams was unsuccessful in his bid for bail in an Armidale court, after a magistrate said he posed an unacceptable risk.
Williams is alleged to have entered an Armidale home on the night of August 19 and stolen a number of items, placing them in a car outside.
He is accused of then re-entering the home, and walking into a female occupant's bedroom, before he allegedly climbed into her bed and placed his hand inside her underwear and indecently assaulted her.
Magistrate Karen Stafford granted the DPP an adjournment to settle the charges to enable a hearing date to be fixed.
"The DPP needs to send some paperwork to their head office, that will take some time," she told Williams, who appeared in court via video link from prison.
"In the meantime, you're to stay in custody."
